Under the Israeli Penal Law, solicitation for prostitution (pimping) carries a sentence of up to five years in prison. This raises the question of whether a past conviction for pimping by an Israeli citizen, who is now in a relationship with a foreign citizen, could impact the chances of regularizing the foreign partner’s status. 
The Ministry of Interior May Refuse to Open a Joint Life File Due to a Pimping Conviction
In principle, it is understood that even convicted individuals have the right to form relationships and establish families. However, the Ministry of Interior’s procedures allow the ministry, when opening a joint life file, to consult external entities (such as the police and security services) and obtain information about the criminal background of Israeli partners. This may lead to a refusal to open a joint life file in exceptional cases, such as when the Israeli partner has been imprisoned or detained. Ministry of Interior representatives have in fact previously denied requests following the conviction of Israeli partners for pimping.
Reasons for Request Denial
There are two main reasons for refusing a request to open a joint life file for the foreign partner of an Israeli pimp One reason is the perception of the relationship not being genuine. Another reason is determining a criminal impediment to the couple’s joint life in Israel. Court Decisions on Residency Status for a Foreign Partner of an Israeli Convicted of Soliciting Prostitution
As mentioned, requests are only denied in exceptional cases based on the criminal past of the Israeli partner. When an appeal is filed against a decision to reject a request to open a joint life file, judicial authorities will closely examine the seriousness of the evidence on which the Ministry of Interior based its refusal. When evidence shows that the offenses were committed a long time ago or are not directly relevant to the couple’s status application, this may lead to the rejection being successfully appealed or the court suggesting that it be re-examined.
One case discussed in the Jerusalem Administrative Court involved a foreign citizen living with an Israeli partner who had previously been convicted of soliciting prostitution and served a prison sentence for said offense. After his release, the couple married and began the process of regularizing the foreign partner’s status in Israel. During this process, the Israeli partner passed away.
The Ministry of Interior ultimately rejected the foreign partner’s (now a widow’s) request for permanent residency, partly based on an impression of insincerity in the relationship. That said, the court ruled that, in principle, the Israeli partner’s criminal past should not automatically prevent the foreign partner from obtaining citizenship, particularly given the time elapsed since the conviction. Additionally, the court noted a positive impression of the couple’s relationship.
In contrast, in another case, the Appeals Tribunal dismissed an appeal by a couple whose request for status regularization was denied. This was based on recent intelligence indicating that the Israeli partner was currently involved in offenses related to human trafficking. The tribunal also found inconsistencies that raised doubts about the sincerity of the relationship. However, it is noteworthy that in this case, the Ministry of Interior informed the tribunal that the couple’s case would be re-examined, which reduced the need for tribunal intervention.
